End User License Agreement [EULA]
IMPORTANT: You should read the following
End User's License Agreement (EULA), terms and conditions, before
creating an account (username), accessing the chat site, before
entering any game, or using any service. Entering an account and
accessing the chat, entering the game, or using any service, indicates
your acceptance of all of the terms and conditions stated below.
If you do not accept the terms and conditions, you are hereby prohibited
from entering!
You agree that the Creators of Call of Combat are not responsible
in any way to you or to any User or to any other person in any way,
for any indirect, special, incidental or consequential damage of
any type or form including, but not limited to, damages for loss
of goodwill, loss of work, computer malfunction, or any other damages
of any kind, as a result of your use of any service by the Creators.
You expressly understand and agree that:
Any material downloaded or otherwise obtained through the use of
the service is done at your own discretion and risk and that you
will be solely responsible for any damage to your computer system
or loss of data that results from the download of any such material.
No advice or information, whether oral or written, obtained by you
from the Creators, or through or from the service shall create any
warranty not expressly stated in the EULA.
In consideration of your use of the service,
you agree to: (a) provide true, accurate, current and complete information
about yourself as prompted by the service's registration form and
(b) maintain and promptly update the registration data to keep it
true, accurate, current and complete. If you provide any information
that is untrue, inaccurate, not current or incomplete, or the Creators
have reasonable grounds to suspect that such information is untrue,
inaccurate, not current or incomplete, the Creators have the right
to suspend or terminate your account and refuse any and all current
or future use of the service, or any portion thereof.
In particular you are required to maintain a current valid email
as a point of contact for the Creators of Call of Combat. Failure to do
so will result in immediate inactivation of your account.
You will receive a password and account (username) upon completing
the service's registration process. You are responsible for maintaining
the confidentiality of the password and account, and are fully responsible
for all activities that occur under your password or account. You
agree to (a) immediately notify the Creators of Call of Combat of
any unauthorized use of your password or account or any other breach
of security, and (b) ensure that you exit from your account at the
end of each session. The Creators cannot and will not be liable
for any loss or damage arising from your failure to comply with
the EULA.
By creating and/or using any account, and/or accessing any service
provided by Call of Combat and/or the Creators, you affirm that
you are age 14 years old, or older. Parents of children under the
age of 14 who wish to allow their children access to the service
must create the account for them. When you create such an account,
you certify that you are at least 18 years old and that you are
the legal guardian of the child/children listed on the account.
By creating such an account, you give your child permission to access
all of the services including, email, message boards, chat(s) and
any other communication methods used in the service. Please remember
that the service is designed to appeal to a broad audience. Accordingly,
as the legal guardian, it is your responsibility to determine whether
the services and/or content are appropriate for your child.
Code of Conduct
By creating and/or using any account, or
service of Call of Combat and/or the Creators, you agree to abide
by the terms of the Code of Conduct listed here: Code of Conduct.
Multiple Accounts
Any individual person is allowed only one
account for service. You agree that you will use only use one username
and account at one time. You also agree that you will only change
your account and/or screen name within the methods set forth by
the Creators of Call of Combat. You agree that the Creators reserve
the right, at their sole discretion, to verify any account information
you have submitted using any and all legal means available. The
use of multiple accounts can result in action being taken against
you by the Creators, as set forth in the section: Violations, Restrictions,
&/or Termination.
Violations, Restrictions, &/or Termination
Violations of this End User’s License
Agreement or any of its terms and conditions, the Code of Conduct,
Monitor Instructions or any other violations can result in action
being taken against you by the Creators including, but not limited
to, discontinuation of service provided by the Creators and/or Call
of Combat. You agree that the Creators, at their sole discretion,
reserve the right to limit, discontinue, or cancel the access and/or
account of any user, at anytime, with or without cause. You waive
any claim of responsibility on the part of the Creators for such
limit, cancellation, or discontinuation of service. You agree to
forfeit any fee or purchase cost that you may have paid in the event
of such a discontinuation of service.
Service
Unless explicitly stated otherwise, any new
features that augment or enhance the current service, including
the release of new properties, shall be subject to the EULA. You
understand and agree that the service is provided "AS-IS"
and that the Creators assume no responsibility for the timeliness,
deletion, mis-delivery or failure to store any user communications
or personalization settings.
The Creators monitor the activity of the Call of Combat game site.
Such monitoring is intended to ensure compliance with the EULA,
Code of Conduct, and thus produce a pleasant gaming environment.
Monitoring is not carried out 24 hours a day. You agree that the
Creators are not responsible for the content of any messages or
items posted by Users of the service. The Creators reserve the right,
at their sole discretion, to discontinue any and all access to chat
of any User.
A list of the registered usernames of the Monitors and the Creators
are available at the Call of Combat website. You agree to abide
by and comply with any and all instructions given to you by the
individuals using these registered usernames. Non-compliance with
such instructions can result in action being taken against you by
the Creators, as set forth in the section: Violations, Restrictions,
&/or Termination.
Fees
You are responsible for obtaining access
to Call of Combat, and that access may involve third party fees
(such as Internet service provider or airtime charges). You are
responsible for those fees, including those fees associated with
the display or delivery of advertisements. In addition, you must
provide and are responsible for all equipment necessary to access
Call of Combat.
Copyright
All Call of Combat software, all titles,
images, sounds and other material related to Call of Combat or the
Call of Combat chat site are protected by the copyright laws of
the United States and by international copyright treaties. Call
of Combat grants Users permission to copy and distribute the material
in its original form only.
Limitation of Liabilities
You accept that the Call of Combat software
constitutes a constantly evolving service and that from time to
time there will be bugs, especially in the BETA stage it is in.
You accept that these bugs may interfere with your ability to enjoy
your privileges as a User or Member, and they may crash your computer
or even affect your data.
Accordingly, the Call of Combat software is provided without warranty
of any kind either express or implied, including, but not limited
to, implied warranties of merchantability and fitness for a particular
purpose. The entire risk as to the quality and performance of the
content appearing on the Call of Combat website(s) and your use
of these items, including the software, rests solely with you, the
User.
You agree that the Creators shall have no liability whatsoever for
any reason based on your use of or participation in the Call of
Combat software, service, and/or website(s). You expressly understand
and agree that the Creators shall not be liable for any direct,
indirect, incidental, special, consequential or exemplary damages,
including but not limited to, damages for loss of profits, goodwill,
use, data or other intangible losses (even if the Creators have
been advised of the possibility of such damages), resulting from:
1. The use or the inability to use the service;
2. The cost of procurement of substitute services resulting from
any data, information or services purchased or obtained or messages
received through or from the service;
3. Unauthorized access to or alteration of your transmissions or
data;
4. Statements or conduct of any third party on the service;
5. or Any other matter relating to the service
In some jurisdictions there is no limitation on liability for negligence
that causes personal injury or death, and the Creators limit their
liability in such jurisdictions only to the degree allowed by the
applicable laws.
"The Creators” includes but is not limited to, any and
all programmer(s), any and all acknowledged “staff”
members, including but not limited to the producer, associate producer(s),
webmaster(s), graphic artist(s), information system manager(s),
community manager(s), map manager(s), media manager(s), quality
assurance personnel, and any and all contract workers, whether compensated
or not, who contributed either at present or previously to Call
of Combat.
** Nothing in this End User’s License Agreement (EULA) shall
preclude or prevent the Creators from changing, modifying, or discontinuing
the terms of service, the Code of Conduct, the EULA itself or any
other document, program, web page, service, or communication, written
or otherwise; and no prior announcement shall be necessary, required,
or implied.
